Notice on the safe discharge of fireworks and firecrackers

In order to further strengthen the safety management of fireworks and firecrackers, prevent and reduce fires and personal injuries caused by fireworks and firecrackers, and earnestly safeguard the safety of people’s lives and property. According to the "People’s Republic of China (PRC) Public Security Administration Punishment Law", "Regulations on the Safety Management of Fireworks and Firecrackers" and other relevant provisions, the relevant matters concerning the safety of fireworks and firecrackers are hereby notified as follows.

First, the safety regulations

(1) Fireworks and firecrackers shall not be set off on balconies, windows, corridors, roofs and parking lots of residential buildings, and fireworks and firecrackers shall not be set off around barns and forage piles in rural areas.

(two) not to people, vehicles, aircraft, buildings, public green areas, wells and pipelines, other underground pipe network throwing lit fireworks.

(three) fireworks and firecrackers shall not hinder the safe passage of pedestrians, vehicles, aircraft and other means of transportation.

(four) minors should be accompanied by their guardians or other adults when setting off fireworks and firecrackers.

(5) It is forbidden to set off fireworks and firecrackers in the following areas: cultural relics protection units, stations, airports, oil and gas tanks (stations), inflammable and explosive dangerous goods storage places within the safety control line of chemical parks and other key fire control units, power transmission and transformation facilities, medical institutions, primary and secondary schools, kindergartens, nursing homes, forests, nurseries and other key fire prevention areas and important military facilities areas.

(VI) The Township People’s governments in Sumu, sub-district offices, housing management departments and property management companies should set up "centralized discharge areas" for fireworks and firecrackers in the open areas of residential areas, and set up prompt signs; Set up "no discharge areas" between buildings, residential roads, parking lots and other areas, and set up warning signs; During the centralized discharge of fireworks and firecrackers, it is necessary to assign special personnel to keep an eye on it and focus on prevention; At the same time, it is necessary to use publicity columns, electronic screens, WeChat groups and other carriers to publicize fire prevention and fire safety knowledge, so that everyone knows it and is a household name.

(seven) when setting off fireworks and firecrackers, it shall be set off correctly in accordance with the discharge instructions marked on the products; Fireworks and firecrackers shall not be set off in a way that endangers public safety and the personal and property safety of others; Fireworks and firecrackers shall not be set off in prohibited areas and places.

(eight) no unit or individual may purchase, sell or discharge fireworks and firecrackers that need to be discharged by professionals, and may not purchase unqualified fireworks and firecrackers through illegal channels.

(9) Without the permission of the public security organ, no unit or individual may hold fireworks parties or other large-scale fireworks display activities.

(ten) the masses should moderately set off fireworks and firecrackers to reduce environmental pollution.

Second, the department supervision responsibilities

(a) the public security organs shall be responsible for the supervision and management of public safety of fireworks and firecrackers, implement safety supervision on the road transportation and discharge of fireworks and firecrackers, and monitor the flow of fireworks and firecrackers; Investigate and deal with illegal manufacturing, trading, storage, transportation, mailing and illegal discharge of fireworks and firecrackers according to law;

(two) the emergency management department is responsible for the safety supervision and management of fireworks production and operation;

(three) the market supervision department is responsible for the quality supervision and management of fireworks products and their packaging;

(four) the transportation department is responsible for the supervision and management of fireworks and firecrackers carrying enterprises, transport vehicles, drivers and escorts;

(five) other relevant departments in accordance with their respective responsibilities, do a good job in the safety management of fireworks and firecrackers.

Third, the provisions on illegal punishment

(1) Where fireworks and firecrackers are set off in the area where fireworks and firecrackers are prohibited, the public security department shall order them to stop setting off in accordance with the relevant provisions of the Regulations on the Safety Management of Fireworks and Firecrackers and impose penalties; If it constitutes a violation of public security administration, it shall be punished according to law;

(II) those who continue to operate fireworks and firecrackers without permission, beyond the permitted business scope or after the license expires, shall be ordered by the emergency management department to stop their illegal business activities in accordance with the relevant provisions of the Measures for the Implementation of Fireworks and Firecrackers Business License, and be punished, and the illegally operated items and illegal income shall be confiscated; If the case constitutes a crime, it shall be handed over to the public security organ for criminal responsibility according to law;

(three) the illegal storage of fireworks and firecrackers, in accordance with the relevant provisions of the "People’s Republic of China (PRC) Public Security Management Punishment Law", by the public security department at more than ten days and less than fifteen days of detention; If the circumstances are minor, they shall be detained for more than five days and less than ten days.

(IV) The Township People’s governments in Sumu, sub-district offices, police stations under their jurisdiction, fire brigades and housing management departments should intensify the inspection and inspection of fireworks and firecrackers safety control, and those who fail to investigate hidden dangers and work behind will be notified and seriously held accountable in accordance with relevant regulations.
